Terms of Service

Foreword

This terms and conditions has two components. The first is the terms of the service offered, and the conditions of the offering for both Unreal hosting network (UT2007Servers) (herafter refered to as Unreal hosting network (UT2007Servers) - meaning the corporation:., its admins, and employees) and you the customer. The second is the level of service we offer you which lays out company policy in regards to any type of issue which the customer (meaning the the renter of the server/service offered) has with the server/service offered.



Terminoligy Used in This Document

·        Machine defines the computer which hosts the gameserver/voice server/website offered by Unreal hosting network (UT2007Servers).

·        Server will be used to define a game server hosting one of the games and/or mods offered by Unreal hosting network (UT2007Servers). Any time 'server' is being used to refer to a voice server or website that will be specified.


·        Lag is not a term directly used or accepted in a technical aspect by Unreal hosting network (UT2007Servers). View the four elements of what makes up what is typically known as 'lag', below.

·        Machine Latency is the term often known as ping. The Latency to a server is the time in milliseconds it takes for data to travel to and then back from the machine the server is hosted on. This is the number you would see in a DOS ping.

·        Server Latency is virtually identical to the Machine Latency, but includes the time it takes for the server to interpret the data and return it to your game client. This is the ping number you see inside of the game.

·        Packet Loss is when data sent to the game server does not arrive there. Many games have meters to see the level of packet loss to the server. In HL/CS/DOD and Quake3 based games it is known as the NetGraph (Lagometer in MOHAA and MOHAAS). In Unreal/UT based games it is viewable via hitting the F6 Key.

·        Choke is when the flow of data going to or from the server is not allowed to flow as widely (meaning as much data) as it would like to be. In HL this is viewable via the NetGraph. It is not listed in any other game as choke, but as the number of packets flowing.

 

Customer Information

 

Customers are responsible for the upkeep of their servers. If your server is down, please notify us as soon as possible. We may be reached via our contact page or you can log into the billing and use the 24/7 ticket support. We monitor our networks and the systems that host our game servers 24 hours a day, 7 days a week, but since we do not monitor game servers on an individual basis, you must notify us if your server crashes, etc. We only monitor our computer systems to ensure that all systems running games servers stay up 24 hours a day, 365 days a year. All game servers are to remain compliant with our Terms of Service at all times. If your server crashes from something you added and we need to fix it you will receive a 10.00 fee for the repair.

Game Server installs come as a basic setup. Additional files and add-ons must be applied by the customer. Any time you make changes to your files, please test those changes on your local computer system first. Please change your files with care. We are not responsible for the files in your game server directories after your game server account is activated.

 

We will patch your server as needed by the game designers at no extra charge. Game servers are set up with the base install according to the game type ordered. If at any time you render your server inoperable, which causes us to do a RE-INSTALL, a $20.00 charge will be issued. The price you pay when ordering the service will remain in effect for the length of your service.

The customer agrees to provide acurate information when they register. Any falsification of registration information with the intent to decieve Unreal hosting network (UT2007Servers) will render all obligations Unreal hosting network (UT2007Servers) has towards the customer null and void. Any change of contact information must be edited by the customer in their profile in the members section of the www.UNREAL server rentalgame.com website.

 

Usage of Services offered by Unreal hosting network (UT2007Servers)

·        Gameservers and the FTP sites associated with them are for the use of only the hosting of the game and making connections to it to play, or to upload files that are to be used by the gameserver software. The customer agrees not to commit any actions which will lower the performance of the gameserver, the other gameservers on the machine, or the machine itself. The customer agrees not to alter any of the settings that affect bandwidth, or CPU usage of the game server. These settings include, but are not limited to: sys_ticrate, sv_maxupdaterate, sv_maxrate, netservermaxtickrate. Any customer who violates/alters these settings and conditions will be subject to a penalty fee of $30    Default tick rate is 20 on all UT/2003/2004/Demo game servers.

·        Websites offered by Unreal hosting network (UT2007Servers) are never to be used to offer FTP file downloads. Unreal hosting network (UT2007Servers) will offer seperate FTP sites for such downloads if needed. The customer agrees not to commit any actions that use excessive bandwidth, or to excessively use the CPU on the machine.

·        Voice servers are to be used specifically for the purpose of voice communication, and no other purpose

·         

·        GAME MOD INSTALLS (UT, UT2003,UT2004 COD and COD2) IF YOU REQUEST US TO REPAIR OR INSTALL A MOD THAT IS NOT DEFAULT WE WILL CHARGE A PER INCIDENT FEE OF 10.00 PER MOD (payable before mod repair install)

·        While in/using any machines, servers, or services offered by Unreal hosting network (UT2007Servers), you may not: Engage in any activities that would cause excessive distress or slander upon any other person; transmit or copy any data that is not owned, lisenced by you, is obscene or racially/ethically objectionable.

·        Any customer caught Hacking Unreal hosting network (UT2007Servers)servers/equipment will have their service terminated and will not recieve a refund. This includes in game hacks on servers not your own (unless given permission by the server owner), hacking the routers, switchs, or operatiing systems on the machines themselves, or through any other type of access (such as FTP, Telnet, SSH, etc).

·        Disk Space The maximum ammount of Hard Drives space allocated to each game server is 4 GB. (cod2 is slightly higher)For each additional GB it is $2.

·        Maxplayers on a game server may not be altered from what you are paying for unless express permission is given by Unreal hosting network (UT2007Servers). Deviation from that will result in a penalty fee of $30.

·        Any Game server used by the customer or the customer's guests after the subscription period has expired will be considered a renewal and result in additional charges.

·        The Standard Network Rate/Speed In our default configs is 8000 (some games it is set to 10000). Cod2 is 15000 This is the max speed that we allow your server to be set to. Adjusting it above this without permission or additional payment will result in increased charges also tick rates are not adjustable.

·        Dissallowed Addons UNREAL server rental does not allow the use of Pingboosters (such as unlag or booster_mm) nor do we allow the use of the TSC for Counter-Strike. We reserve the right to modify this list at any time (we will post changes on the front of the site). Any type of bot (Unreal/Unreal Tournament and UT2003 exempt) will also result in a $30 penalty fee.

·        Private Servers are to remain private. Setting a private server to public (removing the password) will result in you being billed for a public server or shutoff. Also, you are not allowed to put the private server password in the server name, the front (or prominent area) of your website, IRC channel welcome message or spam forums with it. Doing so will result in you being billed for a public server or worst case shut off. We do monitor all private servers 24/7



 

Guarantees of Service offered by Unreal hosting network (UT2007Servers)

·        Network Uptime: Our ISP's offer us between a 98 and a 99% uptime. Given lead time between us and our ISPs we are then offering a 97% network uptime to our customers. This means we guarantee the InterNAP/peer1/Worldcom networks we connect to to be available 698.4 hours out of 720 hours a month (based on a 30 day month) or no more than 21.6 hours of network downtime a month.

·        Machine Uptime: Unreal hosting network (UT2007Servers) Reserves the right to have machines down for scheduled maintenance 12 hours a month and unscheduled maintenance 6 hours a month. This does not include downtime for RCON reboots on Q3X machines.
For hardware failure we reserve the right to have 24 hours a month for dealing with hardware failure on machines. This includes any downtime for hardware failure on such machines as the webservers and the Iguana Host.

·        Power Failures: It is extremely unlikely for any of the datacenters we are in to lose power as they have 3 levels of backup. However, it has happened to us 3 times so far, so we are reserving the right to suffer power losses for 4 hours a month.

·        Server Config Related Downtime: Unreal hosting network (UT2007Servers) offeres no guarantee of uptime where the configuration of the game server instance itself is the cause of the downtime. We will work diligently to get it running again if such downtime occurs. While we do monitor game servers for uptime, it is the customer's responsibility to report any down server issues to us where the cause is misconfiguration.

·        Compensation For Downtime: If a game server is down for longer than the timelimits specified above the compensation is a 1:1 ratio in days. So if the server is down for 25 hours due to hardware failure we will offer 1 day compensation. To recieve 3 days the server would have to be down for over 48 hours, etc....



 

Billing/Renewal

·        Activation/Cancellation All server setups are subject to a one time (server dependant)setup fee. At the end of your term you will have 5 days to make payment for the next term before termination of service occurs.

·        Re-activation Any servers terminated for non-payment and then re-activated within 2 weeks will be subject to a $10 charge .After 2 weeks you pay 30.00 set up fee again.

·        Bounced Checks or Paypal Chargebacks Any bounced checks or Paypal Chargeback for services rendered will be subject to an additional $25 fee.

·        Credit Card Use You must be 18 years of age to submit a payment on Unreal hosting network (UT2007Servers)'s site via credit card. Also, if the name and/or address on the credit card do not match the name and/or address on the customer account with Unreal hosting network (UT2007Servers) the owner of the card must fax us a signed approval allowing us to charge the card.

** Any accounts signed up for with a credit card will be automatically billed on the first of the month for the next month's service. If you do not wish to be autobilled you must open a billing ticket after signing up and request not to have your card billed on the first of the month.

·        Refunds: Unreal hosting network (UT2007Servers) does not offer refunds for either services rendered or for the unused remainder of a service term. The only instances where monetary compensation will occur is in account credits for any downtime as listed above. All cancellations must occur at the end of a term.

·        Unlawful use of services offered by Unreal hosting network (UT2007Servers) will result in immeadiate account termination with no refunds or warning (IE Warez on your server - any programs found on the server that are not freeware or shareware will be considered warez).

·        Personal folders found on the server will be deleted without notice and a warning will be issued. If any subsequent occurances are discoverd a $30 penalty fee will be incurred.



 

Acknowledgements By User

·        Computer and Network/Internet Faults:
You the user acknowledge that computer and network systems are not fault free and there may be times when these systems experience inturruptions and downtime (unavailability). Unreal hosting network (UT2007Servers) does not guarantee uninturrupted service though does make compensation for certain types of inturruption as listed earlier in this document. The user agrees that he/she/they shall make no claim of breach of contract for any such inturruption.

·        Copyrights/Trademarks: The user acknowledges that all copyrights and trademarks (registered and unregisterd), intellectual property, design rights (registered and unregistered), in the website, the machines and the game servers belongs to Unreal hosting network (UT2007Servers) and the user shall not infringe on any of those rights. This includes copying, distrobution and/or modification.

The user acknowledges that certain material is supplied under license and that such property rights are owned by the licensor.

·        Communication: The user acknowledges that they shall not use any unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, racial, sexually oriented, or otherwise objectionable material in communication with Unreal hosting network (UT2007Servers), post such material on the Unreal hosting network (UT2007Servers) forums, or have such material on their servers and or web sites. Unreal hosting network (UT2007Servers) reserves the right to remove any such material it finds objectionable.



 

Liability:

IN NO EVENT WILL UNREAL SERVERS BE LIABLE TO CUSTOMER FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL DAMAGES OR ANY LOSS OF PROFIT, REVENUE, DATA OR GOODWILL WHETHER INCURRED OR SUFFERED AS A RESULT OF UNAVAILABILITY OF THE SERVICES, PERFORMANCE, NONPERFORMANCE, NEGLIGENCE, TERMINATION, BREACH OR ACTION OR INACTION UNDER THIS AGREEMENT EVEN IF CLIENT ADVISES Unreal hosting network (UT2007Servers) OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION ON LIABILITY, HOWEVER, SHALL NOT RELIEVE UNREAL SERVERS FROM LIABILITY FOR DIRECT DAMAGES ARISING SOLELY OUT OF UNREAL SERVERS GROSS NEGLIGENCE OR WANTON OR WILLFUL MISCONDUCT IN PERFORMANCE OF THE HOSTING SERVICES.

 

Acceptance of Terms

The user of any Unreal hosting network (UT2007Servers) service, agrees to be bound by these terms and services. Failure to accept these terms and services means the user does not have permission to access any services offered by Unreal hosting network (UT2007Servers) and must cease use immeadiately.
